What a valid DMCA notice must include

To be effective under 17 U.S.C. § 512(c)(3), a notice of claimed infringement must be a written communication that includes substantially all of the following:

  • Identification of the copyrighted work you claim has been infringed (or a representative list, if multiple works are covered by a single notice).
  • Identification of the material you claim is infringing, with enough detail for us to locate it — please include the full URL of the page on which it appears.
  • Your contact information: name, mailing address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement that the information in the notice is accurate, and, under penalty of perjury, that you are the copyright owner or authorized to act on the owner's behalf.
  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.

Incomplete notices may delay our response. Please note that under 17 U.S.C. § 512(f), knowingly making a material misrepresentation that material is infringing may expose you to liability for damages, including costs and attorneys' fees.

Counter-notices

If your material was removed or disabled and you believe that was a mistake or misidentification, you may send a counter-notice to the same address. A counter-notice must include:

  • Identification of the material that was removed or disabled and the location at which it appeared before removal.
  • A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.
  • Your name, mailing address, telephone number, and email address.
  • A statement that you consent to the jurisdiction of the U.S. District Court for the judicial district in which your address is located (or, if outside the United States, any judicial district in which we may be found), and that you will accept service of process from the person who submitted the original notice or their agent.
  • Your physical or electronic signature.

We may forward a valid counter-notice to the party who submitted the original notice. Removed material may be restored in 10 to 14 business days unless we are informed that a court action has been filed seeking to restrain the allegedly infringing activity.

Repeat infringers

It is our policy, in appropriate circumstances, to disable or terminate the accounts of members or other users who are determined to be repeat infringers. We may also remove material and restrict access at our discretion where we believe infringement has occurred.

Trademark and other rights inquiries

Trademark complaints, right-of-publicity claims, defamation claims, and other rights inquiries may also be sent to a@unveiledd.com. Please describe the right you hold, the material at issue and its URL, and how you would like it addressed, and include contact information so we can respond.

This address is not for customer support

Membership questions, billing, orders, consults, and privacy requests are handled by Customer Service through the contact form linked in the footer of every page. Support messages sent here will be redirected, which slows down the response.
